1. About these terms
These terms and conditions ("Terms") govern your use of the website at growthkey.com.au (the "Site") and any content, downloads, bookings or products you access through it. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Consulting engagements, sprints and advisory programs are governed by a separate written engagement agreement. Where that agreement and these Terms conflict, the engagement agreement applies.

3. Using the Site
You may use the Site for lawful purposes only. You must not:
copy, scrape, or reproduce Site content for commercial use without our written permission;
attempt to gain unauthorised access to any part of the Site, our systems or our data;
use the Site to send spam, malicious code or unlawful material;
misrepresent who you are when submitting a form or booking a call.
We may suspend or restrict access to the Site, or to any download or resource, if we reasonably believe these Terms have been breached.
4. Our content and intellectual property
All content on the Site, including text, graphics, logos, videos, frameworks, checklists, scorecards, playbooks and blog articles, is owned by or licensed to Growth Key and is protected by Australian and international intellectual property laws.
You may view, download and print Site content for your own personal or internal business use. You may not sell, republish, distribute or create derivative works from it without our written permission. The Growth Key name and logo may not be used without our consent.
5. Free resources, articles and general information
The Site provides free resources, articles, videos and tools about scaling, operating and preparing consumer brands for exit. This material is general information based on our own operating experience. It is not tailored to your business, and it is not financial, legal, accounting, regulatory or investment advice.
Before acting on anything you read or download here, consider whether it suits your situation and seek advice from a qualified professional where appropriate. Any figures, case studies or examples drawn from brands we have built or advised describe what happened in those businesses at that time; they do not predict what will happen in yours.
6. No guarantee of results
We do not guarantee any particular outcome, revenue, growth rate, valuation or exit result from using the Site, any free resource, any product or any service. Business results depend on many factors outside our control, including your market, your team, your execution and your funding.
7. Strategy calls and bookings
Strategy calls booked through the Site are free, obligation-free discussions. They are not a consulting engagement and do not create an advisory or fiduciary relationship. Any recommendations made on a call are general in nature and subject to Section 5.
If you need to reschedule or cancel, please use the link in your confirmation email. We may cancel or reschedule a call at our discretion.
8. Purchases through the Site
Where the Site offers paid digital products or programs:
Pricing. Prices are shown in Australian dollars and include GST where applicable, unless stated otherwise. We may change prices at any time; the price you pay is the price displayed at checkout.
Payment. Payment is processed securely by Stripe. We do not store your full card details. By purchasing, you confirm you are authorised to use the payment method provided.
Delivery. Digital products are delivered by email or by access to a members or download page, normally within minutes of payment clearing. If you have not received access within 24 hours, contact [email protected].
Licence. Purchased digital products are licensed to you for your own personal or internal business use. They are not to be shared, resold or redistributed.
Refunds. Nothing in this section limits your rights under the Australian Consumer Law (see Section 11).
9. Third-party links and tools
The Site may link to third-party websites, tools, platforms or services. We do not control them and are not responsible for their content, availability, terms or privacy practices. A link is not an endorsement.
10. Testimonials and case studies
Testimonials and case studies on the Site reflect the experience of the individuals and businesses named, with their permission. They are not a guarantee that you will achieve similar results.
11. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
12. Limitation of liability
To the extent permitted by law:
the Site and its free content are provided "as is" and "as available", without warranty of any kind;
we are not liable for any indirect, incidental, special or consequential loss, or loss of profit, revenue, business, data or goodwill, arising from your use of the Site, any free resource or any product;
where liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant product or service or paying the cost of having it resupplied, or in any case to the amount you paid us for the product or service concerned.
13. Privacy and communications
Our handling of your personal information is set out in our Privacy Policy at growthkey.com.au/privacy-policy, which forms part of these Terms.
When you submit a form, subscribe, download a resource or make a purchase, you agree that we may contact you by email, and by SMS where you have provided a mobile number, about your enquiry, your purchase and related Growth Key content. You can unsubscribe from marketing emails at any time using the link in each email, and reply STOP to opt out of SMS.
14. Changes to the Site and these Terms
We may change, suspend or remove any part of the Site at any time. We may also update these Terms. The current version is always published on this page with the date it was last updated. Continued use of the Site after a change means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
